Family Law

Family Law Act, Ontario

The Family Law Act was passed by Ontario’s Legislative Council in 1990. It oversees the rights of spouses and dependents concerning family property, prenuptial agreements, inheritance, support, divorce/separation etc. There are several areas of family law covered under this act which was amended in 1999 to include same-sex couples.

In Canada, children’s legal rights are not affected by the marital status of their parents, whether they were married at all, living together, or had no relationship.

Ontario laws also define “spouse” to include common-law partners who have been living together for more than one year.

Family law in Ontario also covers domestic contracts and cohabitation agreements.
